Traditional No-Fault Divorce, Collaborative Law, or Mediated Divorce Settlement

As a no-fault divorce lawyer with ten years of experience providing family law services in southern California, it is the mission of my firm to provide my clients with both the knowledge and the opportunity to meaningfully participate in the process of accomplishing their divorce in a manner that empowers them to make their own decisions.

California is a no-fault divorce state. This means that the parties do not need to have legal grounds to get a divorce.

It also means that if one party wants a divorce, the other party has no recourse to stop it from happening. This can be very difficult for some people to accept. My goal in the divorce settlement process is to help my client take back control of their life situation so they can move forward. I am experienced in Collaborative divorce, divorce mediation, and traditional divorce litigation.

The choice of methods to pursue in your case will depend upon the desires of both parties, the level of trust remaining, and the parties' ability to work together. If you can work together to reach agreements, then I strongly suggest using Collaborative Law or divorce mediation. If my client believes that his or her spouse will not participate or is not able to be honest, or if there have been instances of spousal or child abuse, then the case should go to court.

Child Custody and Visitation
California courts urge parents to participate in joint custody. In most cases, shared parenting time is in the best interests of the child. In some cases, it is not. I can help through litigation or mediation.

Child Support and Alimony
In California, child support is based upon a specific child support formula that takes into account the income of both parents. Spousal support is far more complex. Determining the appropriate level of support may require an investigation to ensure that all income has been identified in order for a fair decision to be reached. Collaborative Divorce
After ten years of working with couples in the process of divorce, I have begun to shift my law practice in the direction of collaborative law and mediation for couples for whom this option is appropriate.

Despite the stress you may be facing as the result of the uncertainty of a divorce, the fact remains that you are more qualified to identify and bring about a satisfactory resolution to your divorce than is a judge who does not know you or your family.

Property Settlement
California is a community property state, which means that marital property will be divided "equitably" as part of the divorce settlement. But what does "equitably" mean? I can help you through the process of mediation or litigation to determine what it should mean in your case.
